Past years of practice remain exposed when indemnity protection begins only later.

A colleague calls on a Tuesday evening.

He has been served a legal notice. Specifically, it is for a procedure performed four years ago.

He is completely fine. He was continuously insured.

Then he asks what you would do in his place. Consequently, you go quiet.

You did not buy your first policy until your sixth year of practice. Nobody skipped it deliberately. It simply never reached the top of your list.

Which raises the exact question you have been actively avoiding. Is there such a thing as retroactive cover for years practised without insurance?

First, Find The Date That Controls Everything

Open your insurance policy schedule immediately. Look closely for the retroactive date. Specifically, it is usually the exact day your first policy started. Furthermore, it has stayed the exact same through every renewal since.

Claims made cover requires two things to be true simultaneously. The policy must be active when the patient files the claim. Therefore, the treatment date must fall on or after your retroactive date. Both conditions must be met. Otherwise, you receive nothing.

Insurers hold this firm line for a specific reason. If uninsured years could be bought back, every doctor would wait for a notice before buying cover. How To Stop Your Uninsured Exposure From Growing

You cannot rewrite the last ten years of your practice. However, you can decide what the next ten years look like. The decisions are not complicated.

  • Buy a policy this week: Every day uncovered adds more consultations to your vulnerable pile.
  • Never let cover lapse: Continuous renewal freezes your retroactive date in place permanently.
  • Document consent properly: Ensure consent is procedure specific, discussed, signed, and dated.
  • Maintain records for seven to ten years: Solid medical records win court cases far more often than arguments do.
  • Match cover to your work: A surgeon and a general physician should never carry the same sum insured.

What Every Doctor Must Take Away Today

You cannot insure the years behind you. However, you can stop your financial exposure from multiplying today.

The retroactive date you set today becomes immensely valuable over time. It grows one renewal at a time. However, this only happens if you never break the chain.

Treat your premium as an essential operating cost of practice. Place it in the same column as registration renewals and equipment maintenance. Therefore, it is considerably cheaper than a single legal defense. It is the only part of this risk you still control.
