Radiology errors differ from those in other medical fields because the radiological image serves as a permanent record. This implies that any oversight can be reviewed later, which heightens the possibility of legal action in cases where patients suffer injuries or fatalities due to diagnostic mistakes.

The Significance of Advancements in Radiology

Radiology has undergone significant transformations throughout the years, emerging as an essential tool in modern medicine. This field utilizes various imaging techniques to identify and track different medical conditions. A radiologist, often holding either a Doctor of Medicine (MD) or Diplomate of National Board (DNB) in Radiodiagnosis degree, specializes in diagnosing and treating diseases using medical imaging. These professionals play a crucial role in identifying, diagnosing, and managing a wide array of health conditions.

Radiology in India has made remarkable strides with the adoption of advanced imaging technologies and AI-driven diagnostics, as well as the introduction of Teleradiology, significantly enhancing accuracy and accessibility. However, the rapid integration of these technologies also brings a risk of errors if not carefully managed.

The Rise of Negligence Cases in Radiology

There has been an upward trend in negligence lawsuits involving radiologists. A negligence case where a Malaysian court recently ordered the government to pay 2 million ringgits ($461,893) in a negligence case concerning radiofrequency ablation, as reported by AuntMinnie. Similarly, in India, a Nagpur-based ultrasound center was ordered to pay Rs 1.25 crore to a disabled child and his parents after repeated errors in prenatal ultrasound reports led to congenital anomalies in the child, as reported by the Times of India. These cases highlight the risks radiologists face in their daily practice.

Types of Radiology and Their Risks

When it comes to radiology, there are three primary categories, each with its own set of responsibilities and associated risks:

  1. Diagnostic Radiology: This category encompasses imaging procedures like X-rays, CT scans, MRIs, and ultrasounds. Radiologists utilize these images to identify various conditions, including bone fractures, heart disease, and cancer. Mistakes in interpreting these images can lead to missed or incorrect diagnoses, potentially resulting in legal repercussions.
  2. Interventional Radiology: This field involves using imaging techniques to assist in procedures such as biopsies, stent placements, and tumor treatments. Errors in this area can lead to serious complications, such as vascular injuries, often resulting in negligence claims.
  3. Radiation Oncology: This specialty utilizes radiation therapy to treat cancer. While it is highly effective, any errors in administering radiation doses can have severe consequences, potentially leading to lawsuits. According to the British Journal of Radiology, 40% of cancer patients worldwide benefit from radiation therapy, but even a small error can cause harm.

The Legal Landscape & Professional Risks

According to a recent study by SpringOpen, the main reason behind legal claims against radiologists is diagnostic errors, accounting for 14.83 claims per 1,000 person-years. Other significant causes of lawsuits include procedural complications and miscommunication with patients or other medical professionals. In the field of interventional radiology, vascular injuries stand out as the most common basis for legal action.

In countries like India, radiologists are categorized as “service providers” under the Consumer Protection Act, while patients are considered “consumers.” Negligence claims can result in criminal charges under Section 304A of the Indian Penal Code, which can lead to imprisonment or fines. Radiologists are also subject to the PNDT Act, which prohibits disclosing the gender of a fetus, with violations carrying legal consequences.
