Weather prescribing an eye drop, medicine or performing complicated surgeries like corneal transplants, cataract operations, or treating glaucoma, ophthalmologists are always exposed to the risks of medical negligence claims. A single mistake could not only impact a patient’s vision but also put the healthcare providers reputation at risk. Medical negligence cases in India have risen significantly over the past few decades, with ophthalmologists increasingly facing litigations. According to studies, approximately 5.2 million medical negligence claims are filed annually in India, many of them against surgeons including ophthalmologists. Given the fragile/soft nature of eye-related procedures, even minor mistakes can lead to serious consequences, such as partial or total loss of vision to the patient, which can devastate both patients and the doctors involved.

When such incidents occur, the reputational damage, stress, and financial burden on the doctor can be overwhelming. Legal battles to prove innocence can take years, draining both time and resources. This is where professional indemnity insurance plays a crucial role, offering legal defense and financial support, allowing doctors to focus on their practice without the constant fear of lawsuits hanging over them.

Negligence in Ophthalmology Field

Ophthalmology is one of the most respected medical fields, yet it is also one of the most high-risk specialties. A slight error during a procedure can led to blindness or severe visual impairment to patient and turn the dreams of the bright future and hopes into darkness. According to the National Library of Medicine (NIH), from 2002 to 2018, the National Consumer Disputes Redressal Commission (NCDRC) 942 cases of medical negligence related to ophthalmology. Shockingly, 73.3% of these cases resulted in findings of negligence, with compensation ranging from Rs. 200,000 to Rs. 10 million.

Case Studies of Negligence in Ophthalmologist

  • In one case reported by the Times of India, an ophthalmologist in Gujarat was ordered by a consumer court to pay Rs. 100,000 in compensation after a patient suffered temporary blindness following an Avastin injection. Although complications like Vitreous hemorrhage are known risks of Intravitreal injections, the court ruled the case as negligence and deficiency in service.
  • Another case in Punjab where the State Consumer Disputes Redressal Commission ruling against a hospital and ophthalmologists for medical negligence. The patient, who had diabetes, underwent surgery without proper pre-operative measures to control blood sugar and blood pressure, and without valid informed consent regarding the risks. The hospital was ordered to pay Rs. 200,000 in compensation to the patient’s heirs.

These cases underscore the challenges ophthalmologists face and highlight the importance of safeguarding their practice through Professional Indemnity Insurance.

Ophthalmology Procedures Where the Stakes are Highest

Ophthalmology involves highly complex and high-tech procedures that can have far-reaching consequences if not performed correctly. Below are some of the key surgeries where the risk of negligence is particularly high:

  1. Retinal Detachment Surgery: Retinal detachment requires delicate procedures like pneumatic retinopexy, pars plana vitrectomy, or scleral buckle surgery. Even minor errors in these surgeries can lead to permanent vision loss.
  2. Corneal Surgeries: Techniques such as deep anterior lamellar keratoplasty (DALK) and corneal cross-linking are crucial for treating conditions like keratoconus. However, they carry significant risks if not handled with utmost precision.
  3. Refractive Surgeries: Procedures like Laser-Assisted in Situ Keratomileusis (LASIK) and photorefractive keratectomy (PRK), aimed at correcting vision issues, are highly sought after. However, a mishap during these laser surgeries can result in serious complications, including vision impairment.
  4. Glaucoma Surgeries: Invasive procedures like trabeculectomy and goniotomy are performed to reduce intraocular pressure. Errors here can lead to irreversible damage to the eye’s drainage system, severely impacting the patient’s vision.

The Role of Technological Advancements

While technological advancements have revolutionized ophthalmology, they also bring their own set of challenges. Technologies like femtosecond lasers and advanced intraocular lenses are now commonplace, but the complexity of these tools also increases the potential for mistakes. A slight negligence or an unexpected complication during surgery could lead to negligence claims, reinforcing the need for Professional Indemnity Insurance.
