  3. Implantable Heart-Rhythm Monitors: These devices track a patient’s heart rhythm continuously and alert the doctor if there are irregularities, enabling early intervention. However, misinterpretation of data or device malfunction can lead to complications.
  4. Nanomaterials for Fighting Cholesterol: Nanotechnology is now being used to target and reduce cholesterol buildup in arteries. Though promising, this technology is still evolving, and incorrect use can lead to unintended consequences.
  5. Artificial Intelligence (AI) and Machine Learning (ML): AI and ML are used to interpret data related to heart conditions, predict potential issues, and even assist in diagnosis. However, reliance on these systems needs to be balanced with human expertise to avoid misdiagnoses. Moreover, as the field expands into areas like telemedicine or pain management, the scope of practice and by extension, the potential risks has broadened.

Most Common Risks Associated with Cardiology

While technological advancements have made heart care more effective, the risks associated with cardiology cannot be ignored. Some of the most common risks include:

  1. Surgical Mistakes: Due to the complexity of heart procedures, even a small mistake during surgery can have severe consequences. These errors can lead to claims of malpractice.
  2. Improper Treatment Protocol: If a cardiologist does not follow the correct treatment protocol, it may result in ineffective treatment or harm to the patient. This can lead to legal action if the patient suffers as a result.

Surge In Negligence Cases In Cardiology

Medical negligence in cardiology can occur through various lapses, including misinterpretation or delay in interpreting electrocardiograms (ECGs), echocardiograms, or angiograms, leading to delayed or incorrect diagnoses. Additionally, errors in medication management, such as incorrect dosing or administration of anticoagulants, antiarrhythmics, or beta blockers, can have devastating consequences. Inadequate informed consent, poor communication, and insufficient documentation can further exacerbate liability risks. In a recent case, the National Consumer Dispute Redressal Commission  NCDRC upheld the decision of the Delhi State Consumer Court, which held a hospital and its two cardiologists responsible for medical negligence.

The doctors were ordered to pay Rs 25 lakh compensation to the patient’s wife after the patient died during the treatment. Similarly, The National Consumer Disputes Redressal Commission (NCDRC) in another case, directed a Mohali-based hospital and its doctors, including a senior cardiologist, to pay a compensation of Rs 25 lakh with an interest of 8% to the family of a patient who died due to medical negligence.

Such cases underscores the legal implications of a cardiologist’s actions during treatment and the potential financial impact of a lawsuit.
