Gynecologists dedicate their entire life to nurturing and protecting the health of women, from the miracles of the birth to the complexities of reproductive health. Every pregnancy, surgery, and diagnosis carries unseen risks of medical negligence claims in gynaecology. Gynecologists can face potential lawsuits, damaged reputations, and emotional distress. A single misdiagnosis, surgical error, or delayed diagnosis can lead to lifelong patient harm and costly legal battles.
Advancements In Gynaecology
Recent years have witnessed significant advancements in obstetrics and gynaecology, transforming the way doctors’ diagnose, treat and care for women. Advanced technologies are enhancing patient outcomes, improving safety and streamlining clinical workflows.
Key technologies in Gynaecology are:
Artificial Intelligence In Ultrasound Imaging: AI-powered ultrasound systems enable more accurate fetal monitoring, automated measurements, and enhanced image quality. This technology helps detect potential issues earlier, ensuring timely interventions.
Robot-Assisted Surgery: Minimally invasive robotic surgeries reduce recovery time, scarring, and complications. Advanced robotic systems provide precise control, improved visualization, and enhanced dexterity for surgeons.
Telemedicine And Virtual Consultations: Secure Health Insurance Portability and Accountability Act (HIPAA) compliant telemedicine platforms facilitate remote consultations, expanding access to gynaecological care. Patients can now conveniently schedule virtual appointments, reducing wait times and improving health outcomes. However, the rapid growth of these technologies also brings a risk of errors if not carefully managed.
Potential Risks In Gynaecological Procedures:
Gynaecologists face several challenges which make their work highly susceptible to medical negligence claims. The processes involved in it are highly complex. Every decision, diagnosis, and treatment can have life-changing consequences for patients and far-reaching implications for doctors.
Gynecologists are most vulnerable to negligence claims in:
Pre-Natal and Post–Natal Care: Gynecologists are at risk of negligence claims during pregnancy and after childbirth due to the mistakes in monitoring unborn babies’ health, misdiagnosing conditions affecting mother or baby or Not providing proper care during pregnancy or after delivery.
Surgical Procedures: Gynecologists may also face negligence claims due to complications during Cesarean sections (C-sections), Hysterectomies (removing the uterus) and other surgeries (e.g., tubal ligations, ovarian cyst removal).
Reproductive Health: Negligence claims can also arise from mismanaging fertility treatments (e.g., IVF, IUI), providing incorrect contraceptive advice or failing to diagnose or treat reproductive issues (e.g., endometriosis, PCOS)
Consequence Of Negligence Claims
Emotional Distress and Trauma: Medical negligence claims can take a significant toll on healthcare providers, leading to emotional distress and trauma. The stress of facing a lawsuit can cause anxiety, depression, and loss of confidence, making it challenging for them to continue practicing.
Damage To Reputation And Livelihood: A medical negligence claim can severely damage a healthcare provider’s reputation and livelihood. A single claim can lead to a loss of patients, damage to professional reputation, and difficulty finding new employment.
Costly Lawsuits And Financial Strains: Medical negligence claims can result in significant financial strain for healthcare providers and organizations. Expensive legal fees, high settlement payouts, and increased insurance premiums can drain resources. In extreme cases, medical negligence claims can even lead to bankruptcy, forcing providers to close their practice or file for financial protection.
Medical Negligence Cases In Gynaecology
Gynaecologists face some of the most emotionally charged and complex medical negligence cases. Mistakes in prenatal care, childbirth, or reproductive health can have lifelong consequences for patients. From misdiagnosed ectopic pregnancies to botched hysterectomies, medical errors can lead to physical harm, emotional trauma, and even death.
Recently, the District Consumer Court directed two gynaecologist and IVF Facility’s Head to pay Rs 7,48,230 to a patient who underwent treatment at the facility. After admitting the patient for the delivery of her children, the doctor and the hospital failed to handle the case and referred her to another hospital stating that there was a lack of ICU and Blood bank facility.
Similarly, National Consumer Disputes Redressal Commission (NCDRC) has upheld a Ten year old order of the Kerala Consumer disputes Redressal Commission (KCDRC), holding a gynaecologist and a private hospital responsible for gross medical negligence and ordered the duo to pay Rs 22 lakh as compensation to the complainant.
A Study by National Library Of Medicine analyzed judgments from all District Consumer Courts in South India, focusing on medical negligence cases against gynecology and obstetrics. The study revealed 1,317 negligence cases, with 357 cases related to gynecology and obstetrics topping the list. Notably, negligence was proven in 98 of these 357 cases.
Such cases and studies prove that whether a negligence claim is genuine or dates back 10 years, it can still lead to significant consequences for doctors in the future. Even if the case drags on to many years, doctors must go through the entire legal process and bear the legal charges. Which can drain them financially and mentally.
