When A Doctor Saved the Mother, But Faced Questions About the Baby

From life savior to suspect

In a modest maternity hospital in Hyderabad, a senior gynecologist with over 15 years of experience was overseeing what should have been a routine delivery. She had treated the patient through every stage of pregnancy, not as a case file, but as a family acquaintance, someone she had known for decades. Antenatal care was offered generously, scans arranged at discounted rates, and every check-up personally handled. This wasn’t just medicine; it was trust. On November 4, 2024, that trust was tested in the worst way possible.

What happened that day?

The patient arrived early in the morning with labor pains. The family, overwhelmed by her discomfort, began insisting on a cesarean section. But the clinical parameters, at that moment, suggested otherwise. The doctors opted for monitored labor, as standard in many full-term deliveries. By evening, when the situation grew more complex, the decision was made to operate. At 9:00 PM, a male baby was delivered, but the outcome was devastating. The baby was born asphyxiated. Despite every attempt, he could not be revived. That was not the only tragedy unfolding.

The mother began bleeding excessively. Within minutes, her vitals dropped, and a rare and catastrophic complication, Amniotic Fluid Embolism (AFE), had set in. The doctor, recognizing the severity of the situation, immediately shifted into emergency response mode. Blood was not readily available on-site. The family had to rush to an external blood bank. Four bottles were arranged. Meanwhile, the doctor initiated life-saving procedures, stabilized the patient, and prepared her for an urgent referral to another Hospital. The mother survived, and unfortunately, the baby did not, and within days, the grief turned into legal action.

When did it become a legal crisis?

On March 19, 2025, more than four months after the delivery, a legal notice arrived. The family accused the doctor of negligence for delaying surgery, failing to provide emergency care, and mishandling a full-term delivery. There was no FIR or media spotlight. Just a letter, sharp and accusatory. But in the silent hallways of a clinic, that letter was thunder, and that’s when the doctor reached out to her indemnity partner, CoverYou.

  • A detailed account of the patient’s antenatal history and the trust she had placed in the doctor over nine months.
  • Documentation of clinical decisions and the rationale behind attempting a normal delivery.
  • A medical explanation of Amniotic Fluid Embolism, an unpredictable, high-risk condition with no clear preventable trigger.
  • The emergency steps taken included referral, stabilization, and arranging blood despite logistic challenges.
  • Proof of ethical conduct, including waiving fees and offering continued support post-delivery.

The legal reply was submitted on April 11, 2025, calm in tone but firm in facts. We didn’t just file paperwork but stood beside her, helped her understand the process, and ensured she knew that in this storm, she was not alone.
